Dog Purchasing Contract

This contract is between (Seller)

1)Description of puppy being sold: Sex: _______, DOB:______, Color:__________
Type of AKC Registration being sold with said puppy __________. Reg. #_____________.

For the sum of $________. A non-refundable deposit of $________ was put down to hold said puppy until (Date): ___________________. The rest of the sum will be paid in full prior to pick up. And on or before date included in this contract. All paper work will be held until said puppy is paid in full. If said puppy is not picked up on or before this date, buyer above looses the deposit money and said puppy will be possibly placed back up for sale to a new buyer.

2)Conditions for the Full AKC Registration:
a) All dogs/males will not be used for breeding until at least the age of 1 1/2 year old.
b) All bitches/females will not be used for breeding until t the age of 2 years old, unless permission is granted by the seller prior to any breeding taking place.
c) Buyer agrees not to sell puppies/offspring/bloodlines to pet shops/puppy mills/puppy brokers/unethical breeders and all pet puppies will be placed on a spay/neuter agreements with limited AKC registration. Not all puppies in one litter will be placed on full AKC registration. It is very important we protect these bloodlines and keep them out of unethical breeding programs/kennels or homes. If it is found that new owner is producing puppies and placing them in unsuitable homes of any type said puppy/dog/bitch will be repossessed along with ALL AKC paper work turned back over to Seller. It is agreed upon with this contract that the buyer will be very reasonable with breeding and placing offspring of their Walden puppy.
d)This puppy is not being sold as a brood bitch or stud dog only. This puppy is being placed first as a companion. We do not agree with placing breeding dogs in homes for breeding purposes only and then to be re-homed after breeding career is over. .

3)Conditions with Limited AKC Reg. (with spay/neuter agreement clause)

a) If this Walden puppy is being sold on a limited AKC reg. agreement/contract (see above under description of puppy being sold), then buyer was given a discount of $________ up front for agreeing to the spay (female) or neuter (male) at the time of sale. And ALL AKC paper work/pedigree will be held until proof of spay (females) or neuter (males) is provided to breeder/seller prior to the puppy reaching 8 months of age

b) When proof of such spay/neuter is provided with in the time limit then LIMITED AKC paper work & copy of parents pedigrees will be mailed out by regular postal mail to the address named above. If buyer has moved & does not provide new address, seller is NOT responsible for papers being lost in the mail.

c) If said Walden puppy is not spayed or neutered prior to 8 months of age & vet paper has not been provided then buyer is subject to returning said Walden puppy back to seller at NO CHARGE to seller.

4)Seller Representations: The following representations & conditions to the sale of the aforementioned dog.
a)As of the date of this agreement, the dog/puppy is in good health & free of communicable diseases. Rabies tag (providing age appropriate) & vaccination & de-worming schedule.
b)The buyer is completely satisfied with & waives any & all claims regarding the dog/puppy's appearance.
c)At the time of this mating that produced this litter, sire & dam were in good health.

4)Conditions of Sale or Placement
a) Seller can not guarantee size, temperament, conformation, over all health or show quality. All of these can also be determined by care & nutrition.
b) Buyer agrees to provide obedience training classes by a professional trainer if needed, proper socialization, a safe-healthy environment for said puppy. Proper medical care, heartworm preventative and to keep said puppy in good health mentally & physically.
c) *** If Buyer can no longer keep this puppy at any time, puppy is to be returned to Marsha Walden (seller) at no charge to seller along with all AKC paper work & any health records. No puppy/dog can be given, sold or otherwise transferred to another person at any time, with out written permission of seller in writing. Action will be taken in court if buyer places said puppy/dog and does not honor this contract, seller will sue for up to purchase price for said puppy/dog or the recovery of said dog.
Great Danes do not do well home jumping and we approve the original home to be a forever home and our puppies or dogs can not be placed with out our careful home screening process.
Any breach of this contract will result in loss of ownership of said puppy/dog along with AKC paper work & health records. And return of said puppy will be the responsibility/cost of the buyer. If all parts of this contract has not been fulfilled. If for any reason this contract must be settled in a court of law, buyer agrees to be responsible for all court costs. Place of Venue is in the County of Montgomery and the State of Arkansas. To protect both the animal and the kennel's reputation, we have had to include these clauses. If the buyer is found to be breach of any portion of this contract, the buyer agrees to relinquish ownership of said puppy back to Marsha Walden. This agreement is mutually stipulated to have been entered into Montgomery County of Arkansas. Regardless of where signed or state said puppy is going to live. Buyer and Seller agree that proper venue for any legal action is taken to enforce the terms and conditions of this agreement shall lie in Montgomery County, Arkansas.
